1. Who You Are Contracting With

herFunds is operated by Elson Solutions ("herFunds", "we", "us", "our"). When you use the Platform or purchase a subscription or digital product through us, you are entering into a contract with Elson Solutions. By accessing or using herFunds, you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform.

2. Description of Service

herFunds is a discovery and aggregation platform that helps women entrepreneurs find funding opportunities including grants, venture capital, angel investment, accelerators, incubators, mentorship programs, and investment education resources. herFunds does not provide funding directly and does not guarantee the accuracy, availability, or outcome of any listed opportunity.

3. User Responsibilities

You agree to:

  • Use the Platform only for lawful purposes
  • Provide accurate account information and keep it up to date
  • Maintain the confidentiality of your account credentials
  • Verify opportunity details directly with the funding organization before applying
  • Not scrape, reproduce, or redistribute Platform content without permission
  • Not attempt to interfere with the Platform's operation or security

4. Payments, Subscriptions & Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, currency conversion, sales tax, cancellation, and refund mechanics are governed by Paddle's Checkout / Buyer Terms. In addition:

  • Subscriptions (Explorer, Explorer Pro) are offered on a monthly or annual basis at the prices displayed at checkout. Subscriptions auto-renew at the end of each billing cycle at the then-current price until cancelled.
  • Cancellation: you may cancel at any time via the customer portal provided by Paddle. Cancellation takes effect at the end of the current billing cycle; you keep access until then.
  • One-time purchases (ebooks, coaching sessions, and other digital products) are charged once and delivered electronically.
  • Price changes: we may change prices for future renewals with reasonable advance notice. Continued use after the change constitutes acceptance.
  • Refunds are governed by our Refund Policy and ultimately handled by Paddle as the Merchant of Record.

5. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. herFunds does not warrant that opportunity listings are complete, accurate, current, or error-free. Funding details, deadlines, eligibility, and amounts may change without notice by the organizations offering them.

6. Limitation of Liability

To the maximum extent permitted by law, Elson Solutions, its founders, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Platform, reliance on opportunity information, or inability to access the Platform. Our aggregate liability shall not exceed the fees you paid us in the 12 months preceding the claim.

7. Intellectual Property

All content on herFunds, including text, graphics, logos, and software, is the property of Elson Solutions or its content suppliers and is protected by applicable intellectual property laws. The herFunds name and logo are trademarks of Elson Solutions.

8. Third-Party Links

herFunds contains links to external websites of funding organizations. We are not responsible for the content, privacy practices, or availability of these third-party sites. Linking does not imply endorsement.

9. Suspension & Termination

We may suspend or terminate your access to the Platform, in whole or in part, at any time and without prior notice if we reasonably believe that you have:

  • materially breached these Terms or any other applicable policy;
  • failed to pay any amount due, including after a failed subscription renewal;
  • used the Platform unlawfully, fraudulently, or in a way that poses a security risk;
  • infringed the intellectual property or rights of herFunds or any third party; or
  • repeatedly or seriously violated our acceptable-use rules.

You may stop using the Platform and close your account at any time. On termination, your right to use the Platform ends immediately; sections that by their nature survive (IP, liability, governing law) will continue to apply.

10. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
